AN ACT TO AMEND THE CODE OF LAW-S OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-1-136 SO AS TO PROVIDE PENALTIES FOR CONSPIRACY TO VIOLATE TITLE 50 PROVISIONS OF LAW, RELATING TO FISH, GAME, AND WATERCRAFT.

Be it enacted by the General Assembly of the State of South Carolina:

Penalty

SECTION 1. The 1976 Code is amended by adding:

"Section 50-1-136. Notwithstanding the provisions of Section 16-17-410 and any other provisions of law, every person who conspires to violate any provisions of the game and fish laws of this State or any other provision of Title 50, except the provisions of the Federal Migratory Bird Treaty Act or regulations promulgated by authority of that act, is guilty of a misdemeanor and upon convictionNext is subject to a penalty not greater than that provided by law for the violation. Every person who conspires to violate two or more provisions of the game and fish laws of this State or any other provision of Title 50, except the provisions of the Federal Migratory Bird Treaty Act or regulations promulgated by authority of that act, is guilty of a misdemeanor and upon Previousconviction must be fined not more than two thousand dollars or imprisoned for not more than one year, or both. In addition to the criminal penalty, any person convicted of such conspiracy shall have his privilege to hunt or fish either recreationally or commercially revoked for one year."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
