THE COMMITTEE ON EDUCATION AND PUBLIC WORKS

To whom was referred a Bill (H. 3375), to amend the Code of Laws of South Carolina, 1976, by adding Section 56-5-3890 so as to prohibit persons under fifteen years of age from riding in the open bed of a pickup truck, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/SECTION 1. The 1976 Code is amended by adding:

"Section 56-5-3890. It is unlawful for a person under fifteen years of age to stand in the open bed of a pickup truck or trailer or to sit on a movable object within the open bed of a pickup truck or trailer, if the vehicle is in motion. The operator of a motor vehicle who permits a person under fifteen years of age to ride in the open bed of a pickup truck or trailer in a manner prohibited by this section is guilty of a misdemeanor and, upon convictionNext, must be fined not more than twenty-five dollars or imprisoned not more than thirty days, or both."

SECTION 2. This act takes effect upon approval by the Governor./

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-3890 SO AS TO PROHIBIT PERSONS UNDER FIFTEEN YEARS OF AGE FROM RIDING IN THE OPEN BED OF A PICKUP TRUCK OR TRAILER.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 56-5-3890. It is unlawful for a person under fifteen years of age to ride in the open bed of a pickup truck or trailer. The operator of a motor vehicle who permits a person under fifteen years of age to ride in the open bed of a pickup truck or trailer is guilty of a misdemeanor and, upon Previousconviction, must be fined not more than five hundred dollars or imprisoned not more than six months, or both."

SECTION 2. This act takes effect upon approval by the Governor.
