THE COMMITTEE ON FISH, GAME AND
FORESTRY
To whom was referred a Bill (S. 307), to amend the Code of Laws
of South Carolina, 1976, by
adding Section 50-21-175, so as to provide that any person under the
age of fourteen operating a motorboat must be accompanied by
another person, etc., respectfully
REPORT:
That they have duly and carefully considered the same, and
recommend that the same do pass with amendment:
Amend the bill, as and if amended, by striking all after the enacting
words and inserting:
/SECTION 1. The 1976 Code is amended by adding:
"Section 50-21-175. (A) A person under fourteen years of
age operating a motor boat must be accompanied by another person
eighteen years of age or older.
(B) A person fourteen years of age but less than eighteen years of
age may not operate a motor boat on the waters of this State until the
person shows proof of successful completion of a boating safety
course recognized by the National Association of State Boating Law
Administrators.
(C) For purposes of this section, `motor boat' is defined as in
Section 50-21-10(3) and includes vessels commonly referred to as
`personal watercraft'. However, for purposes of this section,
`propulsion machinery', does not include an electric motor when the
motor is used as the only means of mechanical propulsion of a vessel. (D) A person violating this section is guilty of a misdemeanor and,
upon conviction, must be fined not more than two hundred dollars or
imprisoned not more than thirty days.
SECTION 2. This act takes effect upon approval by the
Governor, except Section 50-21-175(B) of the 1976 Code which takes
effect July 1, 1994./

A BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976,
BY ADDING SECTION 50-21-175, SO AS TO PROVIDE THAT
ANY PERSON UNDER THE AGE OF FOURTEEN OPERATING
A MOTORBOAT MUST BE ACCOMPANIED BY ANOTHER
PERSON AT LEAST EIGHTEEN YEARS OF AGE AND TO
PROVIDE PENALTIES FOR VIOLATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 50-21-175. Any person under the age of fourteen
operating a motorboat must be accompanied by another person
eighteen years of age or older.
Any person violating the provisions of this section is guilty of a
misdemeanor and, upon conviction, must be fined not more than two
hundred dollars or imprisoned for not more than thirty days."
SECTION 2. This act takes effect upon approval by the Governor.
