That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, Section 56-5-3910(C), SECTION 1, page 1, line 33, by striking /twenty-five hundred/ and inserting:

Amend title to conform.

STATEMENT OF ESTIMATED FISCAL IMPACT

House Bill 3843 amends the Code of Laws of South Carolina, 1976, by adding Section 56-5-3910 so as to prohibit persons under fifteen years of age from standing or sitting in the open bed of a pickup truck or trailer under certain circumstances, and to provide penalties of a misdemeanor and upon convictionNext fined not more than twenty-five hundred dollars or imprisoned not more than thirty days, or both.

Passage of this legislation would not result in any fiscal impact to the General Fund of the State.

Pursuant to Section 2-7-76 of the South Carolina Code of Laws, 1976, the Office of State Budget surveyed the 24 members of the FIST Network with 6 respondents. Four respondents indicated the cost to administer the legislation was negligible. The remaining two respondents indicated there would be no additional cost to their county.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-3910 SO AS TO PROHIBIT PERSONS UNDER FIFTEEN YEARS OF AGE FROM STANDING OR SITTING IN THE OPEN BED OF A PICKUP TRUCK OR TRAILER UNDER CERTAIN CIRCUMSTANCES, AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 56-5-3910. (A) It is unlawful for a person under fifteen years of age to stand or sit in the open bed of a pickup truck or trailer while it is traveling in excess of twenty-five miles an hour on a public road or highway.

(B) Subsection (A) does not apply when the vehicle is being:

(1) used for hunting;

(2) operated in an agricultural enterprise; or

(3) operated in an organized hay ride or parade.

(C) The operator of a motor vehicle who permits a person under fifteen years of age to ride in the open bed of a pickup truck or trailer in violation of this section is guilty of a misdemeanor and, upon Previousconviction, must be fined not more than twenty-five hundred dollars or imprisoned not more than thirty days, or both."

SECTION 2. This act takes effect upon approval by the Governor.
