A BILL

TO AMEND SECTION 27-35-160, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO UNLAWFUL ABANDONMENT OF BUILDINGS WITHOUT NOTICE, SO AS TO PROVIDE THAT A TENANT WHO ABANDONS A PREMISE AND CAUSES DAMAGE IN EXCESS OF HIS SECURITY DEPOSIT IS GUILTY OF A MISDEMEANOR, AND PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 27-35-160 of the 1976 Code is amended to read:

"Section 27-35-160. (A) Any A tenant abandoning a building and leaving it open and exposed to vandalism without giving notice to the landlord of such this action shall be deemed is guilty of a misdemeanor and shall, upon convictionNext, must be fined not more than one hundred dollars or be imprisoned for not more than thirty days.

(B) A tenant who abandons a premise and causes damages to the property in excess of his security deposit is guilty of a misdemeanor and, upon Previousconviction, must be fined not more than one hundred dollars or be imprisoned for not more than thirty days."

SECTION 2. This act takes effect upon approval by the Governor.
