S 989 Session 123 (2019-2020) S 0989 General Bill, By Goldfinch A BILL TO AMEND SECTION 59-53-810 OF THE 1976 CODE, RELATING TO THE HORRY-GEORGETOWN TECHNICAL COLLEGE COMMISSION, TO PROVIDE THAT APPOINTMENTS FROM GEORGETOWN COUNTY MUST BE MADE BY THE GOVERNOR UPON THE RECOMMENDATION OF A MAJORITY OF THE GEORGETOWN COUNTY LEGISLATIVE DELEGATION, INCLUDING THE RESIDENT SENATOR; AND TO AMEND SECTION 59-53-840, RELATING TO THE ACCOUNTS OF THE COMMISSION AND AUDITS, TO MAKE CONFORMING CHANGES.
TO AMEND SECTION 59-53-810 OF THE 1976 CODE, RELATING TO THE HORRY-GEORGETOWN TECHNICAL COLLEGE COMMISSION, TO PROVIDE THAT APPOINTMENTS FROM GEORGETOWN COUNTY MUST BE MADE BY THE GOVERNOR UPON THE RECOMMENDATION OF A MAJORITY OF THE GEORGETOWN COUNTY LEGISLATIVE DELEGATION, INCLUDING THE RESIDENT SENATOR; AND TO AMEND SECTION 59-53-840, RELATING TO THE ACCOUNTS OF THE COMMISSION AND AUDITS, TO MAKE CONFORMING CHANGES. Be it enacted by the General Assembly of the State of South Carolina: SECTION 1. Section 59-53-810 of the 1976 Code is amended to read: "Section 59-53-810. (A) There is created, as a body politic and corporate of Horry and Georgetown Counties, the 'Horry-Georgetown Technical College Commission' (the 'commission'), consisting of six qualified electors of Horry County and three of Georgetown County. (B) Appointments to the commission from Horry County must be made by the Governor, upon the recommendation of a majority of the Horry County legislative delegation, including the resident Senator.
(C) Appointments to the commission from Georgetown County must be made by the Governor (D) Members shall serve for terms of three years and until their successors are appointed and qualify. If a vacancy arises, a successor may be appointed by the Governor for the balance of the unexpired term in the same manner as the original appointment. The commission shall elect a chairman, a vice-chairman, and a secretary." SECTION 2. Section 59-53-840 of the 1976 Code is amended to read: "Section 59-53-840. The Commission shall at all times keep full and accurate account of its acts and of its receipts and expenditures, and at least once within four months, following the close of its fiscal year, a complete audit of its affairs shall be made by a qualified public accountant. Copies of the audit shall be filed with the secretary of each county legislative delegation.
SECTION 3. This act takes effect upon approval by the Governor.
