A Bill to amend Section 7-9-90, Code of Laws of South Carolina, 1976, relating
to state committees of political parties, so as to provide that county
conventions shall elect one member of the committee for every one-forty-sixth,
or majority fraction of it, of the number of votes cast for the candidate of
the party in the last preceding general gubernatorial election, to require the
State Election Commission to furnish information necessary to implement the
election of county members, to provide that the initial committee of a newly
formed party must be composed of one member from each county and its state
chairman and vice-chairman, and to provide for the selection of the executive
committee of a political party.

A BILL
TO AMEND SECTION 7-9-90, CODE OF LAWS OF SOUTH
CAROLINA, 1976, RELATING TO STATE COMMITTEES OF
POLITICAL PARTIES, SO AS TO PROVIDE THAT COUNTY
CONVENTIONS SHALL ELECT ONE MEMBER OF THE
COMMITTEE FOR EVERY ONE-FORTY-SIXTH, OR MAJORITY
FRACTION OF IT, OF THE NUMBER OF VOTES CAST FOR THE
CANDIDATE OF THE PARTY IN THE LAST PRECEDING
GENERAL GUBERNATORIAL ELECTION, TO REQUIRE THE
STATE ELECTION COMMISSION TO FURNISH INFORMATION
NECESSARY TO IMPLEMENT THE ELECTION OF COUNTY
MEMBERS, TO PROVIDE THAT THE INITIAL COMMITTEE OF
A NEWLY FORMED PARTY MUST BE COMPOSED OF ONE
MEMBER FROM EACH COUNTY AND ITS STATE CHAIRMAN
AND VICE-CHAIRMAN, AND TO PROVIDE FOR THE
SELECTION OF THE EXECUTIVE COMMITTEE OF A POLITICAL
PARTY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 7-9-90 of the 1976 Code is amended to read:
"Section 7-9-90. The state committee shall be
is composed of one member from each county, to be elected
by the county conventions, and the state chairman and state
vice-chairman, to be elected by the state convention, and
each county convention shall elect one member of the state committee
for every one-forty-sixth, or majority fraction of it, of the number of
votes cast for the candidate of the party in the last preceding
gubernatorial election. Each county must be assigned at least
one member. Those persons named as members of the national
executive committee of a national party shall be are ex
officio members of the state committee. If the office of state chairman
or state vice-chairman shall become becomes vacant
by death, resignation or otherwise, the state committee may fill
the vacancy by electing a chairman or vice-chairman to serve until the
organization of the next regular state convention. The state committee
shall choose its other officers, not necessarily members thereof
of it. The state chairman shall may vote only
in case of a tie. The state committee shall meet at the call of the
state chairman or any five members and at such
a time and place as he may appoint. Vacancies on the state
committee other than in the offices of state chairman and state
vice-chairman, however occurring, shall must be filled
by the respective county committees. The members of the state
committee shall continue in office for two years from the
time of their election, and until their successors have been
elected. The state committee shall nominate presidential
electors, and any a vacancy in the state ticket
of electors or in the national committee of a party, however occurring
shall must be filled by the state committee; all by
a majority of the whole committee. The initial committee of a newly
formed party must be composed of one member from each county and
its ex officio members. The State Election Commission shall make all
compilations necessary to determine the assignment of committee
members from the various counties. The compilations must be furnished
by the commission to each registered political party within six months
after each statewide general election. A political party may determine
the composition and the manner of selecting the members of its
executive committee. The determination may be made at a regular state
convention of the party by majority vote of the delegates."
SECTION 2. This act takes effect upon approval by the Governor.
