A Bill to require the Allendale County Board of Education to submit a budget
and annual tax levy to the county auditor, to authorize the Board to set the
school tax millage annually with certain limitations, to require a public
hearing on the proposed millage, and to require a referendum to exceed the
authorized millage; and to repeal Sections 21-1101 and 21-1102, as amended,
Code of Laws of South Carolina, 1962, relating to the powers and duties of the
Board of Education of Allendale and the legislative delegation's authority to
set the annual school tax millage; and to provide that the preparation of the
budget by the Board is effective for school year beginning 1993-94.-amended

AN ACT TO REQUIRE THE ALLENDALE COUNTY BOARD OF
EDUCATION TO SUBMIT A BUDGET AND ANNUAL TAX LEVY
TO THE COUNTY AUDITOR, TO AUTHORIZE THE BOARD TO SET
THE SCHOOL TAX MILLAGE ANNUALLY WITH CERTAIN
LIMITATIONS, TO REQUIRE A PUBLIC HEARING ON THE
PROPOSED MILLAGE, AND TO REQUIRE A REFERENDUM TO
EXCEED THE AUTHORIZED MILLAGE; AND TO REPEAL
SECTIONS 21-1101 AND 21-1102, AS AMENDED, CODE OF LAWS
OF SOUTH CAROLINA, 1962, RELATING TO THE POWERS AND
DUTIES OF THE BOARD OF EDUCATION OF ALLENDALE
COUNTY AND THE LEGISLATIVE DELEGATION'S AUTHORITY
TO SET THE ANNUAL SCHOOL TAX MILLAGE; AND TO
PROVIDE THAT THE PREPARATION OF THE BUDGET BY THE
BOARD IS EFFECTIVE FOR SCHOOL YEAR BEGINNING
1993-94.
Be it enacted by the General Assembly of the State of South Carolina:
Budget for Allendale County Board of Education
SECTION 1. The Allendale County Board of Education shall prepare
and submit to the county auditor on or before April first of each year a
proposed budget and an annual tax levy for the ensuing school year. In
order to obtain funds to implement this budget the board may impose an
annual tax levy, not to exceed the preceding year's millage by more than
four mills, excluding the required inflation factor contained in the
Education Improvement Act and the Education Finance Act.
The board shall hold a public hearing on the budget and proposed tax
levy at least two weeks before submitting the budget and annual tax levy
to the county auditor. Notice of the hearing must be advertised in a
newspaper of general circulation in the county and must state the purpose,
date, time, and place of the hearing and a clearly worded statement of the
proposed annual tax levy.
Any increase exceeding the preceding year's millage by more than four
mills, excluding the required inflation factor contained in the Education
Improvement Act and the Education Finance Act, must be authorized by
referendum of the registered voters of the district, at district expense.
Upon certification by the board to the county auditor of the tax levy to
be imposed each year, the auditor shall levy and the county treasurer shall
collect the millage upon all taxable property in the county and place it in a
separate interest-bearing account with the interest to accrue to the
account.
Sections repealed
SECTION 2. Sections 21-1101 and 21-1102 of the 1962 Code are
repealed.
Limitation on effective date
SECTION 3. This act applies to school years beginning with the
1993-94 school year.
Time effective
SECTION 4. This act takes effect upon approval by the Governor.
