A BILL
TO AMEND ACT 452 OF 1973, AS AMENDED, RELATING TO THE
CHARLESTON COUNTY SUBSTANCE ABUSE COMMISSION, SO
AS TO PROVIDE THAT MEMBERS ARE APPOINTED UPON
RECOMMENDATION OF THE COUNTY COUNCIL RATHER
THAN RECOMMENDATION OF THE COUNTY DELEGATION.
Amend Title To Conform
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 1 of Act 452 of 1973, as last amended by Act
730 of 1978, is further amended to read:
"Section 1. There is hereby created the Charleston
County Substance Abuse Commission to be composed of nine members
who shall must be qualified electors of the county.
Of the initial members of the commission, three must be members of
the Charleston County Commission for Drug Abuse Control to be
appointed by the Governor upon the recommendation of the membership
of that commission, three shall be members of the Trident Council on
Alcohol and Drug Abuse to be appointed by the Governor upon the
recommendation of the membership of that council and three shall be
appointed by the Governor upon the recommendation of the Charleston
County Legislative Delegation, including the resident Senators.
Thereafter, the The members of the commission
shall must be appointed by the Governor upon the
recommendation of the Charleston County Council
Legislative Delegation, including the resident Senators. The
members of the commission shall be are appointed for
terms of three years and until their successors are appointed and
qualify, except that of the initial members of the commission, three
shall serve for terms of one year, three shall serve for terms of two years
and three shall serve for terms of three years. All vacancies
shall must be filled by appointment of the Governor
upon the recommendation of the Charleston County Legislative
Delegation, including the resident Senators, Council for the
remainder of the unexpired term. No member of the commission may
serve more than two consecutive terms on the commission, except that
persons appointed to fill a vacancy for the remainder of an unexpired
term may be reappointed for two additional consecutive terms.
Except as provided herein, A persons
person who are directly is involved in
any a current or proposed substance abuse treatment or
educational programs program or in law enforcement
or who hold holds elective public office may not serve
on the commission but may serve on an advisory
committees committee established by the commission
under the provisions of this act."
SECTION 2. Those members of the Charleston County Substance
Abuse Commission serving pursuant to act 730 of 1978 immediately
before the effective date of this act shall continue to serve until their
terms expire under the provisions of that act. As terms expire under Act
730 of 1978 or vacancies occur, these positions must be filled in
accordance with this act.
SECTION 3. This act takes effect July 1, 1991.
