A Bill to amend Act 510 of 1982, relating to the Anderson County Board of
Education, so as to increase the membership from seven to nine persons, to
provide for the manner of election of the board members, to delete the
provision that all members be elected countywide, to provide for the
expiration of the terms of the current members, and to provide for the initial
terms of the new board elected in 1990.

AN ACT TO AMEND ACT 510 OF 1982, RELATING TO THE ANDERSON COUNTY BOARD OF
EDUCATION, SO AS TO INCREASE THE MEMBERSHIP FROM SEVEN TO NINE PERSONS, TO
PROVIDE FOR THE MANNER OF ELECTION OF THE BOARD MEMBERS, TO DELETE THE PROVISION
THAT ALL MEMBERS BE ELECTED COUNTYWIDE, TO PROVIDE FOR THE EXPIRATION OF THE
TERMS OF THE CURRENT MEMBERS, AND TO PROVIDE FOR THE INITIAL TERMS OF THE NEW
BOARD ELECTED IN 1990.
Be it enacted by the General Assembly of the State of South Carolina:
Membership increased, etc.
SECTION 1. Section 1 of Act 510 of 1982 is amended to read:
"Section 1. The Anderson County public school system is governed by the
county board of education composed of nine members. Two members must be elected
at large from School District 1 by the qualified electors of that district, four
members must be elected at large from School District 5 by the qualified electors
of that district, and one member each must be elected from School Districts 2,
3, and 4 by the respective qualified electors of each of those districts. The
members may not hold an official position with the public schools of the county
or receive compensation for goods or services rendered to the schools. The
members' powers and duties are as provided in this act. The members must be
elected from the five school districts of the county, as provided in this
section. The members must be legal residents of the school district from which
they are elected. Members of the county board of education must be elected for
four-year terms in the general election. Terms of the members begin on the first
day of January following the general election, and members shall serve until
their successors are elected and qualify. Vacancies on the county board of
education must be filled by appointment by the Anderson County legislative
delegation, and the appointees shall serve until the next general election at
which time a successor must be elected."
Staggered terms, etc.
SECTION 2. The current members of the Anderson County Board of Education shall
continue to serve until the members provided for in this act are elected and
qualify in the 1990 general election. The terms of the members elected in the
1990 general election must be staggered as follows: the members elected from
School Districts 2, 3, and 4 and the members from School Districts 1 and 5 who
receive, respectively, the highest number of votes in their at-large election
contests shall serve initial terms of four years. The member from School
District 1 who finishes second in his at-large election contest and the members
from School District 5 who finish second, third, and fourth, respectively, in
their at-large election contest shall all serve initial terms of two years. The
successors of all of the members of the board elected in 1990 shall serve
four-year terms.

SECTION 3. This act takes effect upon approval by the Governor. |
