A BILL
TO CREATE A REGISTRATION AND ELECTIONS COMMISSION
FOR DORCHESTER COUNTY, ABOLISH THE COMMISSIONERS
OF ELECTION AND THE REGISTRATION BOARD OF
DORCHESTER COUNTY AND DEVOLVE THEIR POWERS AND
DUTIES UPON THE CREATED COMMISSION, AND CONTINUE
TERMS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. (A) There is created the Registration and Elections
Commission for Dorchester County composed of seven members
appointed by the Governor upon the recommendation of a majority of
the Dorchester County Legislative Delegation, including the Senators.
(B) The commissioners must be appointed between January first
and March fifteenth of even-numbered years for four-year terms until
their successors are appointed and qualify and may succeed themselves.
(C) A vacancy may be filled in the manner of original
appointment for the unexpired term.
(D) The commissioners shall receive compensation appropriated
by the county council. Funds provided in Section 7-23-10 of the 1976
Code must be disbursed to the commissioners upon receipt by the county
treasurer.
(E) No officer of a county committee of a political party may
serve on the commission. A commissioner may not serve as a paid staff
employee of the commission while a commissioner.
SECTION 2. The Commissioners of Election and the Registration
Board for Dorchester County are abolished. Their powers and duties are
devolved upon the commission created in Section 1.
SECTION 3. Members of the Election Commission and Registration
Board for Dorchester County serving on March 1, 1991, continue to
serve until appointments are made pursuant to Section 1. The Governor
shall specify three initial appointees to serve three years and four to
serve four years.
SECTION 4. This act takes effect upon approval by the Governor.
