A Bill to amend Act 119 of 1963, as amended, relating to the Newberry County
Water and Sewer Authority, so as to provide for the members of the Authority,
one from each county council district, to be appointed by the Governor upon
the recommendation of a majority of the Newberry County Council members
instead of the legislative delegation; to limit the consecutive terms to two;
and to provide for the expiration of the terms of the present members and for
the initial terms of the members provided for in this Act.-amended title

AN ACT TO AMEND ACT 119 OF 1963, AS AMENDED, RELATING TO THE NEWBERRY COUNTY
WATER AND SEWER AUTHORITY, SO AS TO PROVIDE FOR THE MEMBERS OF THE AUTHORITY, ONE
FROM EACH COUNTY COUNCIL DISTRICT, TO BE APPOINTED BY THE GOVERNOR UPON THE
RECOMMENDATION OF A MAJORITY OF THE NEWBERRY COUNTY COUNCIL MEMBERS INSTEAD OF
THE LEGISLATIVE DELEGATION; TO LIMIT THE CONSECUTIVE TERMS TO TWO; AND TO PROVIDE
FOR THE EXPIRATION OF THE TERMS OF THE PRESENT MEMBERS AND FOR THE INITIAL TERMS
OF THE MEMBERS PROVIDED FOR IN THIS ACT.
Be it enacted by the General Assembly of the State of South Carolina:
Members recommended by Newberry County Council; two consecutive terms
SECTION 1. Section 2 of Act 119 of 1963, as last amended by Act 190 of 1969,
is further amended to read:
"Section 2. The authority must be composed of seven resident electors of
Newberry County, one from each county council district, to be appointed by the
Governor upon the recommendation of a majority of the members of the Newberry
County Council. The terms of the members are for four years and until their
successors are appointed and qualify. No member may serve more than two
consecutive terms. All vacancies must be filled in the same manner as the
original appointment for the unexpired portion of the term only."
Expiration of terms; initial terms
SECTION 2. The terms of the present members of the Newberry County Water and
Sewer Authority expire on the effective date of this act. Initially, of the
members provided for in this act, two must be appointed for terms of one year,
two must be appointed for terms of two years, and three must be appointed for
terms of four years. After the initial terms, all members must be appointed for
terms of four years as provided in this act.
Time effective
SECTION 3. This act takes effect upon approval by the Governor. |
