AN ACT TO PROVIDE FOR THE ELECTION OF SCHOOL TRUSTEES FOR SCHOOL DISTRICTS
NOS. 2 AND 17 OF SUMTER COUNTY; TO REPEAL ACT 980 OF 1974 RELATING TO THE
ELECTION OF SCHOOL TRUSTEES FOR SCHOOL DISTRICT NO. 2 AND TO AMEND ACT 101 OF
1949, RELATING TO SCHOOL DISTRICT NO. 17 OF SUMTER COUNTY, SO AS TO DELETE
SECTION 4 RELATING TO THE ELECTION OF SCHOOL TRUSTEES.
Be it enacted by the General Assembly of the State of South Carolina:
Composition of boards of trustees of school districts in Sumter County
Section 1. The boards of trustees of School Districts Nos. 2 and 17 of
Sumter County shall consist of seven qualified electors of each school
district to be elected in nonpartisan elections by the qualified electors of
the districts on the first Tuesday in May of each year when elections shall be
necessary. The terms of the trustees shall be for four years and limit their
successors are elected and qualify, Such terms to commence July first
following their election. Vacancies shall be filled by appointment of the
Governor upon the recommendation of the remaining trustees of the district for
the unexpired portion of the term only.
For the purpose of electing the trustees in School District No. 2, the
district shall be divided into three areas. Area No. 1 shall consist of
Pinewood Division, Sumter W. Division (less E.D.'s 94, 96 and 97), Sumter S.W.
Division, Privateer Division and Horatio Division (less E.D. 88). Area No. 2
shall consist of Rembert Division, Sumter N.W. Division, Sumter N. Division
(less E.D.'s 80 and 81), and Shaw Division (plus E.D. 88). Area No. 3 shall
consist of Sumter N.E. Division (less E.D. 74), Sumter S.E. Division (less
E.D.'s 18, 19, 20 and 21), Shiloh Division and Mayesville Division. Two
members shall be elected from each area and one member shall be elected from
the district at large. Each trustee shall be a resident of the area he
represents and in the event a trustee moves from his area but remains a
resident of the district, he may continue to serve for the remainder of his
term.
Conduct of election
Section 2. At least sixty days prior to any such election, the county clerk
of court shall publish a notice of the election, the time for filing by
candidates, the number of trustees to be elected and all filing requirements
and deadline dates in a newspaper of general circulation in Sumter County and
at least once a week for two successive weeks thereafter. The notice shall
require all candidates to qualify by filing with the clerk of court no later
than thirty days prior to the election.
Notice of election
Section 2A. Notwithstanding any other provision of this act, the elections
scheduled to be held pursuant to this act in November, 1980, shall require
only thirty days' notice to be given by the clerk of court prior to the
election and the period for filing shall be fourteen days.
Clerk to certify candidates
Section 3. Upon the expiration of time for filing, the clerk shall certify
to the county election commission the names of the persons qualifying as
candidates and shall provide the commission with an advertisement setting
forth the names of the candidates, the date of the election, the number to be
elected, the terms of office, the hours of election which shall be from 8:00
a. m. to 7:00 p. m. and all other pertinent information.
Responsibilities of election commission
Section 4. The county election commission shall conduct the elections,
appoint the managers of the election, designate the places of election,
receive in writing the returns of the managers and declare the results
thereof. The costs of conducting the elections shall be paid by the school
districts.
Election of successors
Section 5. Notwithstanding any other provision of this act, the successors
to the trustees whose terms expire in 1980 shall be elected in nonpartisan
elections to be held at the same time as the 1980 general election. Those
elected from District 17 shall take office the first Monday following their
election with terms to expire June 30, 1984. Those elected from District 2 in
1980 and 1982 shall take office December first following their election with
terms to expire June thirtieth of the appropriate year. The elections shall be
conducted under the same terms and conditions as provided in Sections 2, 3 and
4 of this act.
Terms
Section 6. The terms of the two members of District 17 whose terms expire in
1981 are hereby extended until June 30, 1982. The terms of the other members
of District 17 are hereby extended until June thirtieth of the year in which
their present terms expire. The provisions of this act shall not affect the
expiration date of the terms of the present members of District 2.
Section 7. Section 4 of Act 101 of 1949 (Sections 21-4064 and 21-4065 of the
1962 Code) and Act 980 of 1974 (Sections 21-4079 and 21-4080 of the 1962 Code)
are repealed.
Time effective
Section 8. This act shall take effect upon approval by the Governor. |
