H 4851 General Bill, By J.H. Hodges and Boan
A Bill to amend Act 777 of 1988, as amended, relating to the establishment of
the Lancaster County School District, so as to decrease from nine to seven the
number of members of the board of trustees, provide that each member of the
board must be elected from single-member election districts from which members
of the Lancaster County Council are elected, delete transitional provisions,
provide for the staggering of terms of the newly elected members, provide that
members serving on the effective date of this Act shall serve the remainder of
the term for which they were elected, to provide that a vacancy occurring at
least one hundred twenty days before a general election must be filled by a
special election, and delete the provisions relating to the establishment of
single-member election districts.

A BILL
TO AMEND ACT 777 OF 1988, AS AMENDED, RELATING TO THE
ESTABLISHMENT OF THE LANCASTER COUNTY SCHOOL
DISTRICT, SO AS TO DECREASE FROM NINE TO SEVEN THE
NUMBER OF MEMBERS OF THE BOARD OF TRUSTEES,
PROVIDE THAT EACH MEMBER OF THE BOARD MUST BE
ELECTED FROM SINGLE-MEMBER ELECTION DISTRICTS
FROM WHICH MEMBERS OF THE LANCASTER COUNTY
COUNCIL ARE ELECTED, DELETE TRANSITIONAL
PROVISIONS, PROVIDE FOR THE STAGGERING OF TERMS OF
THE NEWLY ELECTED MEMBERS, PROVIDE THAT MEMBERS
SERVING ON THE EFFECTIVE DATE OF THIS ACT SHALL
SERVE THE REMAINDER OF THE TERM FOR WHICH THEY
WERE ELECTED, TO PROVIDE THAT A VACANCY OCCURRING
AT LEAST ONE HUNDRED TWENTY DAYS BEFORE A
GENERAL ELECTION MUST BE FILLED BY A SPECIAL
ELECTION, AND DELETE THE PROVISIONS RELATING TO THE
ESTABLISHMENT OF SINGLE-MEMBER ELECTION DISTRICTS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Sections 2 and 3 of Act 777 of 1988 are amended to
read:
"Section 2. Beginning with the certification of the
members of the board of trustees elected at the time of the general
election of 1988 1992, the Lancaster County School
District Board of Trustees shall consist of nine seven
members who must be elected from single-member election districts as
provided in Section 3. The terms of all present at-large members
serving on the effective date of this act expire at that
time shall serve the remainder of the term for which they were
elected. However, the four members of the current Lancaster
County School Board of Education who represent Andrew Jackson,
Buford, Indian Land, and Lancaster area boards of trustees shall hold
over and be members of the Lancaster County School District until the
successors to the members elected from Districts 2, 4, 6, and 8 are
elected in the general election of 1990 as provided in this section. An
election of the trustees must be held at the time of the general election
in 1988. The members first elected after the effective date of
this act from Districts 2, 4, 6, and 8 shall serve until their successors are
elected in the general election of 1990. The members first elected after
the effective date of this act from Districts 1, 3, 5, 7, and 9 shall serve
until their successors are elected in the general election of 1992. At the
1990 general election, the members must be elected for terms of four
years and until their successors are elected and qualify. At the
time of the 1992 general election, members from Districts 2 and 6 shall
receive four-year terms and the member from District 5 shall receive a
two-year term. At the time of the 1994 general election, members from
Districts 1, 3, 5, and 7 shall receive four-year terms and the member
from District 4 shall receive a two-year term. At the time of the 1996
general election and each election after that time, all members must be
elected for terms of four years and until their successors are elected and
qualify. The candidate receiving the highest number of the votes
in each district in the general election must be declared elected.
Vacancies on the board must be filled by special election if the vacancy
occurs ninety one hundred twenty days or more prior
to before the general election. If the vacancy occurs less
than ninety one hundred twenty days prior to
before the general election, the vacancy may not be filled.
Section 3. The Lancaster County School District Board of
Trustees must be elected from each of the following
seven single-member election districts: from which
members of the Lancaster County Council are elected. If the district
lines from which members of the county council are elected change, then
the applicable district lines for the election of the board of trustees for
the school district shall change accordingly.
