AN ACT TO PROVIDE THAT TRUSTEES OF THE GEORGETOWN PreviousCOUNTYNext SCHOOL DISTRICT MUST BE ELECTED IN A NONPARTISAN ELECTION HELD AT THE TIME OF THE GENERAL ELECTION, TO PROVIDE THAT PERSONS MAY BECOME CANDIDATES BY FILING A STATEMENT OF CANDIDACY, AND TO PROVIDE THE METHOD OF DETERMINING RESULTS AND THE DATE THE TRUSTEES TAKE OFFICE.

Be it enacted by the General Assembly of the State of South Carolina:

Trustees of Georgetown PreviousCountyNext School District to be elected in nonpartisan elections

SECTION 1. (A) Beginning with the 1994 election, the trustees of the Georgetown PreviousCountyNext School District must be elected in a nonpartisan election held at the time of the general election. All persons desiring to qualify as a candidate shall file written notice of candidacy with the PreviouscountyNext election commission at least sixty days before the date set for the election but not earlier than ninety days before the election. The filing fee must be determined by the PreviouscountyNext election commission. This notice of candidacy must be a sworn statement and must include the candidate's name, age, residence address, voting precinct, and other information the PreviouscountyNext election commission requires.

(B) The PreviouscountyNext commissioners of election shall conduct and supervise the elections for trustees of the district in the manner governed by the election laws of this State, mutatis mutandis. The commissioners shall prepare the necessary ballots, appoint managers for the voting precincts, and do all things necessary to carry out the elections, including the PreviouscountingNext of ballots and declaring the results. The commissioners shall advertise the date of the election ninety days preceding the election in a newspaper of general circulation published in the district and shall publish a second notice thirty days before the election.

(C) The results of the election must be determined in the manner provided in Section 5-15-62 of the 1976 Code for the determination of election results under the nonpartisan election and runoff election method.

(D) The trustees of the district elected in these nonpartisan elections take office one week following certification of their election as provided in Section 59-19-315 of the 1976 Code.

Trustees to continue to serve

SECTION 2. Trustees of the Georgetown PreviousCounty School District whose terms end after 1994 shall continue to serve until the expiration of their terms, after which their successors must be elected as provided in this act.

Time effective

SECTION 3. This act takes effect upon approval by the Governor.
