STATEMENT OF ESTIMATED FISCAL IMPACT

This bill would have no impact on the general fund.

Based on accommodations tax collections for fiscal year 1996, this bill would allow the PreviouscountiesNext of Florence, Georgetown, Lexington and Spartanburg to be exempt from Sunday closing (blue) laws.

A BILL

TO AMEND SECTION 53-1-150, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTION OF A PreviousCOUNTYNext FROM THE SUNDAY CLOSING (BLUE) LAWS BASED ON ACCOMMODATIONS TAX REVENUES IN THE PreviousCOUNTYNext, SO AS TO LOWER THE EXEMPTION THRESHOLD FROM NINE HUNDRED THOUSAND DOLLARS IN A FISCAL YEAR TO FOUR HUNDRED FIFTY THOUSAND DOLLARS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 53-1-150(B) of the 1976 Code, as last amended by Act 134 of 1995, is further amended to read:

"(B) The provisions of Chapter 1 of Title 53 do not apply to any PreviouscountyNext area, as defined in Section 6-4-5(1), which collects more than nine hundred four hundred fifty thousand dollars in one fiscal year in revenues from the accommodations tax provided for in Section 12-36-2630(3) and imposed in Section 12-36-920(A). After a Previouscounty area has collected more than nine hundred four hundred fifty thousand dollars in one fiscal year in revenues from the accommodations tax provided for in Section 12-36-2630(3) and imposed in Section 12-36-920(A), the exclusion from the provisions of Chapter 1 of Title 53 will continue from year to year irrespective of whether revenue falls below nine hundred four hundred fifty thousand dollars in subsequent years."

SECTION 2. This act takes effect upon approval by the Governor.
