To whom was referred a Bill (S. 236) to amend Section 56-1-510, as amended, Code of Laws of South Carolina, 1976, relating to the unlawful use of a driver's license or identification card, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, Section 56-1-510(1) as contained in SECTION 1, by deleting / PreviouscounterfeitNext / on line 34, page 1, and inserting / PreviouscounterfeitedNext /

As amended Section 56-1-510(1) shall read:

/(1)    to display or cause or permit to be displayed or have in his possession any a canceled, revoked, suspended, PreviouscounterfeitedNext, or fraudulently altered driver's license or personal identification card; /

Renumber sections to conform.

Amend title to conform.

TO AMEND SECTION 56-1-510, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE UNLAWFUL USE OF A DRIVER'S LICENSE OR IDENTIFICATION CARD AND SUBMITTING A FRAUDULENT APPLICATION FOR A DRIVER'S LICENSE OR IDENTIFICATION CARD, SO AS TO PROVIDE THAT IT IS UNLAWFUL TO DISPLAY OR POSSESS A PreviousCOUNTERFEITNext DRIVER'S LICENSE OR IDENTIFICATION CARD; AND TO AMEND SECTION 56-1-515, RELATING TO THE UNLAWFUL ALTERATION, SALE, ISSUANCE, OR USE OF A DRIVER'S LICENSE OR IDENTIFICATION CARD, SO AS TO PROVIDE THAT IT IS UNLAWFUL FOR A PERSON TO PRODUCE OR POSSESS A PreviousCOUNTERFEITNext DRIVER'S LICENSE OR IDENTIFICATION CARD.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.        Section 56-1-510(1) of the 1976 Code is amended to read:

"(1)    to display or cause or permit to be displayed or have in his possession any a canceled, revoked, suspended, PreviouscounterfeitNext, or fraudulently altered driver's license or personal identification card;"

SECTION    2.    Section 56-1-515 of the 1976 Code is amended to read:

"Section 56-1-515.    (1)(A)    It is unlawful for any a person to produce a PreviouscounterfeitNext motor vehicle driver's license or identification card, to alter a motor vehicle driver's license or identification card so as to provide false information on the license or card, or to sell or issue a fictitious motor vehicle driver's license or identification card.

(2)(B)    It is unlawful for a person to have in his possession a Previouscounterfeit motor vehicle driver's license or identification card.

(C)    It is unlawful for any a person to use a motor vehicle driver's license or identification card not issued to the person, an altered motor vehicle driver's license or identification card, an a motor vehicle driver's license or identification card containing false information, or an a motor vehicle driver's license or identification card not issued to the person to defraud another person or violate the law.

(3)(D)    Any A person violating the provisions of subsection (1)(A) is guilty of a misdemeanor, and, upon conviction, must be fined not more than two thousand five hundred dollars, or imprisoned for not more than six months, or both.

(4)(E)    Any A person violating the provisions of subsection (2) subsections (B) or (C) is guilty of a misdemeanor, and, upon conviction, must be fined not more than one hundred dollars, or imprisoned for not more than thirty days."

SECTION    3.    This act takes effect upon approval by the Governor.
