A BILL

TO AMEND ACT 518 OF 1982, AS AMENDED, RELATING TO THE SCHOOL DISTRICT OF BERKELEY PreviousCOUNTYNext, THE ELECTION OF ITS MEMBERS, AND THE AUTHORITY OF THE PreviousCOUNTYNext BOARD OF EDUCATION TO PREPARE AN OPERATIONAL BUDGET AND SET THE NECESSARY TAX MILLAGE TO SUPPORT THE MILLAGE, SO AS TO PROVIDE THAT THE GOVERNING BODY OF BERKELEY PreviousCOUNTYNext SHALL APPROVE BOTH THE BUDGET AND THE TAX MILLAGE NECESSARY TO FUND THE BUDGET.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 5 of Act 518 of 1982 is amended to read:

"Section 5.    Notwithstanding any other provision of law, the Berkeley PreviousCountyNext Board of Education is empowered to prepare an operational budget for the school district and to set the necessary tax millage for general school purposes of the district as reflected in the budget. The governing body of Berkeley PreviousCountyNext shall approve both the budget and the tax millage necessary to fund the budget. For this purpose, the board shall furnish to the Auditor and Treasurer of Berkeley PreviousCountyNext before the second day of September of each year the school budget of the district for the ensuing year together with a certification as to the tax millage set by the board and approved by the Previouscounty governing body in order to finance the general school purposes of the district for that year as reflected in the budget. This tax levy shall be must be assessed and collected in the same manner as other ad valorem property taxes are assessed and collected."

SECTION    2.    This act takes effect upon approval by the Governor.
