A Bill to amend Chapter 3, Title 17 of the Code of Laws of South Carolina,
1976, relating to the defense of indigents, by adding Section 17-3-65 so as to
require the General Assembly to appropriate to the Commission on Indigent
Defense, the Commission on Appellate Defense, and otherwise for Indigent
Defense Funds which are, in the aggregate, equal to the funds appropriated to
the Prosecution Coordination Commission and otherwise appropriated to or on
behalf of circuit solicitors for prosecution of criminal cases, and to require
each county to provide to the county defender corporation and for appointed
private counsel in indigent cases funds which are, in the aggregate, equal to
the funds provided by the county to the circuit solicitor's office.

A BILL
TO AMEND CHAPTER 3, TITLE 17 OF THE CODE OF LAWS
OF SOUTH CAROLINA, 1976, RELATING TO THE DEFENSE
OF INDIGENTS, BY ADDING SECTION 17-3-65 SO AS TO
REQUIRE THE GENERAL ASSEMBLY TO APPROPRIATE TO
THE COMMISSION ON INDIGENT DEFENSE, THE
COMMISSION ON APPELLATE DEFENSE, AND OTHERWISE
FOR INDIGENT DEFENSE FUNDS WHICH ARE, IN THE
AGGREGATE, EQUAL TO THE FUNDS APPROPRIATED TO
THE PROSECUTION COORDINATION COMMISSION AND
OTHERWISE APPROPRIATED TO OR ON BEHALF OF
CIRCUIT SOLICITORS FOR PROSECUTION OF CRIMINAL
CASES, AND TO REQUIRE EACH COUNTY TO PROVIDE TO
THE COUNTY DEFENDER CORPORATION AND FOR
APPOINTED PRIVATE COUNSEL IN INDIGENT CASES
FUNDS WHICH ARE, IN THE AGGREGATE, EQUAL TO THE
FUNDS PROVIDED BY THE COUNTY TO THE CIRCUIT
SOLICITOR'S OFFICE.
Be it enacted by the General Assembly of the State of South
Carolina:
SECTION 1. Chapter 3, Title 17 of the 1976 Code is amended
by adding:
"Section 17-3-65. (A) The General Assembly shall
appropriate to the Commission on Indigent Defense, the
Commission on Appellate Defense, and otherwise for indigent
defense funds which are, in the aggregate, equal to the funds
appropriated to the Prosecution Coordination Commission and
otherwise appropriated to or on behalf of circuit solicitors for
prosecution of criminal cases.
(B) Each county shall provide to the county defender
corporation and for appointed private counsel in indigent defense
cases funds which are, in the aggregate, equal to the funds provided
by the county to the circuit solicitor's office."
SECTION 2. This act takes effect upon approval by the
Governor.
