A BILL

TO AMEND SECTION 4-10-30, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REFERENDUM IMPLEMENTING LOCAL OPTION SALES AND USE TAX WITHIN A PreviousCOUNTYNext, SO AS TO PROVIDE THAT IF AFTER THREE REFERENDA IN WHICH THE QUESTION IS NOT APPROVED, A SUBSEQUENT REFERENDUM MAY BE HELD ONLY IF FIFTEEN PERCENT OF THE QUALIFIED ELECTORS OF A PreviousCOUNTYNext PRESENT A PETITION REQUESTING A REFERENDUM TO THE GOVERNING BODY OF THE PreviousCOUNTYNext.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 4-10-30(C) of the 1976 Code is amended to read:

"(C) If the question is not approved at the initial referendum, the PreviouscountyNext council may call for another referendum on the question. However, following the initial referendum, a referendum for this purpose must not be held more often than once in twelve months and must be held on the Tuesday following the first Monday in November. If the question is not approved after three referenda, a subsequent referendum may be held only if fifteen percent of the qualified electors of a PreviouscountyNext present a petition requesting a referendum to the governing body of the Previouscounty."

SECTION 2. This act takes effect upon approval by the Governor.
