A BILL
TO AMEND CHAPTER 3, TITLE 56, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO MOTOR VEHICLE REGISTRATION AND LICENSING, BY ADDING ARTICLE 34 SO AS TO ALLOW THE DEPARTMENT OF PUBLIC SAFETY TO ISSUE SPECIAL MOTOR VEHICLE LICENSES TO VETERANS OF FOREIGN WARS; AND TO REPEAL ARTICLE 60, CHAPTER 3 OF TITLE 56, RELATING TO THE DEPARTMENT OF PUBLIC SAFETY'S AUTHORITY TO ISSUE SPECIAL LICENSE PLATES TO MEMBERS OF THE SHRINERS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 3, Title 56 of the 1976 Code is amended by adding:
"Article 34
Veterans of Foreign Wars License Plates
Section 56-3-3400. (A) The department may issue a special motor vehicle license plate to a veteran of a foreign war who is a resident of the State for a private passenger motor vehicle owned by the veteran.
(B) The special license plate must be of the same size and general design as regular motor vehicle license plates upon which must be imprinted on decals to be affixed on the license plate the veteran's branch of service and the foreign war in which he participated. The decals are to be determined by the public along with numbers, letters, or both, as determined by the department. The biennial fee for the special license plate is the regular motor vehicle registration fee prescribed by Article 5 of this chapter. The plates must be issued for biennial periods of November first to October thirty-first.
(C) The department may issue a special license plate provided by this section to a person who provides the department evidence that he is a veteran of a foreign war.
(D) A license plate issued pursuant to this article may be transferred to another vehicle of the same weight class owned by the same person upon an application approved by the department. It is unlawful for a person to whom a license plate has been issued to knowingly permit it to be displayed on a vehicle except the one authorized by the department."
SECTION 2. Article 60 of Chapter 3 of Title 56 of the 1976 Code is repealed.
SECTION 3. This act takes effect upon approval by the Governor.
