A JOINT RESOLUTION

PROPOSING AN AMENDMENT TO PreviousARTICLENext IV OF THE CONSTITUTION OF SOUTH CAROLINA, 1895, RELATING TO THE EXECUTIVE DEPARTMENT OF STATE GOVERNMENT BY ADDING SECTION 22, SO AS TO PROVIDE THAT THE GOVERNOR, IN EXERCISING THE AUTHORITY TO VETO SPECIFIC ITEMS IN BILLS OR JOINT RESOLUTIONS APPROPRIATING STATE FUNDS MUST CONFORM TO THE REQUIREMENT OF THE STATE CONSTITUTION THAT THE STATE'S BUDGET PROCESS MUST ENSURE THAT ANNUAL STATE EXPENDITURES MAY NOT EXCEED ANNUAL STATE REVENUES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1. It is proposed that PreviousArticleNext IV of the Constitution of this State be amended by adding a section at the end to read:

    "Section 22.    In exercising the authority allowed pursuant to Section 21 of this PreviousarticleNext with respect to bills or joint resolutions appropriating money out of the State Treasury, the Governor must conform to the requirement of Section 7(a), PreviousArticleNext X of this Constitution that the state's budget process must ensure that annual expenditures of state government may not exceed annual state revenue."

SECTION    2.    The proposed amendment must be submitted to the qualified electors at the next general election for representatives. Ballots must be provided at the various voting precincts with the following words printed or written on the ballot:

    "Must PreviousArticle IV of the Constitution of this State relating to the executive department of state government be amended by adding Section 22 so as to provide that in exercising the authority to veto specific items in bills or joint resolutions appropriating state funds, the Governor must conform to the requirement of the state constitution that the state's budget process must ensure that annual expenditures of state government may not exceed annual state revenue?

Those voting in favor of the question shall deposit a ballot with a check or cross mark in the square after the word 'Yes', and those voting against the question shall deposit a ballot with a check or cross mark in the square after the word 'No'."
