A BILL
TO AMEND CHAPTER 1, TITLE 1, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE ADMINISTRATION OF GOVERNMENT BY ADDING ARTICLE 20 SO AS TO REQUIRE BOARDS AND COMMISSIONS TO REPORT NEWLY ELECTED AND APPOINTED MEMBERS AND VACANCIES TO THE SECRETARY OF STATE AND TO REQUIRE THE SECRETARY OF STATE TO MAINTAIN A COMPREHENSIVE DATABASE CONTAINING ALL MEMBERS OF BOARDS AND COMMISSIONS AND THE INFORMATION REQUIRED TO BE REPORTED PURSUANT TO THIS ARTICLE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 1, Title 1 of the 1976 Code, is amended by adding:
"Article 20
Reporting and Records of
State Boards and Commissions Membership
Section 1-1-1310. (A) Every state board and commission shall forward written notification to the Secretary of State's Office of the appointment or election of any person to its board or commission. The notification must be sent within two weeks after confirmation of appointment or election and shall include the governing statute or Executive Order authorizing the appointment or election, the member's name, address, phone number, fax number and e-mail address, if any, district, circuit, seat or position if applicable, when the term begins and ends, and the name of the former member and whether it is a reappointment or reelection of an incumbent.
(B) Every state board and commission shall provide written notification to the Secretary of State's Office of the name of any person who resigns from the membership on that board or commission or of vacancies that occur on that board or commission for any other reason. This written notice must be sent within two weeks of the vacancy and must include the name of the person vacating the position, the district, circuit, seat or position requirements, qualifications, and whether the position is a paid position.
(C) The Secretary of State's Office shall keep a comprehensive database, available to the public, of all members of every state board and commission including the information required by subsections (A) and (B), and a written ledger of this information to be maintained as a public record."
SECTION 2. This act takes effect upon approval by the Governor.
