A JOINT RESOLUTION PROPOSING AN AMENDMENT TO SECTION 28, ARTICLE III, OF THE
CONSTITUTION OF SOUTH CAROLINA, 1895, RELATING TO CERTAIN PROPERTY WHICH IS
EXEMPT FROM ATTACHMENT, LEVY AND SALE, SO AS TO PROVIDE THAT THE GENERAL
ASSEMBLY SHALL ENACT SUCH LAWS AS WILL EXEMPT REAL AND PERSONAL PROPERTY OF A
DEBTOR FROM ATTACHMENT, LEVY AND SALE AND TO DELETE VARIOUS PROVISIONS
RELATING TO EXISTING SPECIFIC EXEMPTIONS AND EXCEPTIONS THERETO.
Be it enacted by the General Assembly of the State of South Carolina:
Amendment proposed
Section 1. It is proposed that Section 28 of Article III of the Constitution
of this State be amended to read:
"Section 28. The General Assembly shall enact such laws as will exempt
real and personal property of a debtor from attachment, levy and sale under
any mesne or final process issued by any court or bankruptcy proceeding."
Question submitted to electors
Section 2. The proposed amendment shall be submitted to the qualified
electors at the next general election for representatives. Ballots shall be
provided at the various voting precincts with the following words printed or
written thereon: "Shall Section 28 of Article III of the Constitution of
this State be amended so as to provide that the General Assembly shall enact
such laws as will exempt real and personal property of a debtor from
attachment, levy and sale and to delete various provisions relating to
existing specific exemptions and exceptions thereto?
In favor of the amendment _________
Opposed to the amendment _________
Those voting in favor of the amendment shall deposit a ballot with a check
or cross mark in the square after the words 'In favor of the amendment', and
those voting against the amendment shall deposit a ballot with a check or
cross mark in the square after the words 'Opposed to the amendment'."
