THE COMMITTEE ON JUDICIARY
To whom was referred a Bill (S. 959), to amend Article 3, Chapter 17,
Title 14, Code of Laws of South Carolina, 1976, relating to clerks of
court, by adding Section 14-17-375 so as to require the clerks of court
to provide reports to consumer reporting agencies, etc., respectfully

A BILL
TO AMEND ARTICLE 3, CHAPTER 17, TITLE 14, CODE OF LAWS
OF SOUTH CAROLINA, 1976, RELATING TO CLERKS OF
COURT, BY ADDING SECTION 14-17-375 SO AS TO REQUIRE
THE CLERKS OF COURT TO PROVIDE REPORTS TO
CONSUMER REPORTING AGENCIES OF PERSONS
DELINQUENT IN CHILD SUPPORT PAYMENTS IN EXCESS OF
ONE THOUSAND DOLLARS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 5, Chapter 5, Title 43 of the 1976 Code is
amended by adding:
"Section 43-5-585. The department shall provide consumer
credit reporting agencies an automated monthly report of obligors in
Title IV-D cases who have not made a payment on their child support
obligation for two consecutive months.
The department shall establish procedures for notice and an
opportunity for a review for obligors who contest the submission to the
consumer credit reporting agency. The procedures shall limit the review
to a dispute concerning the identity of the obligor or the existence or
amount of the arrearage."
SECTION 2. This act takes effect January 1, 1996.
