CAROLINA, 1976, RELATING TO PATRIOT'S POINT DEVELOPMENT AUTHORITY, BY ADDING
SECTION 51-13-726, SO AS TO PROVIDE FOR AN ADDITIONAL MEMBER OF THE GOVERNING

DEVELOPMENT AUTHORITY, SO AS TO FURTHER PROVIDE
FOR THE APPOINTMENT OF BOARD MEMBERS; AND TO
AMEND ARTICLE 11, CHAPTER 13, TITLE 51, CODE OF
LAWS OF SOUTH CAROLINA, 1976, RELATING TO
PATRIOT'S POINT DEVELOPMENT AUTHORITY, BY
ADDING SECTION 51-13-726, SO AS TO PROVIDE FOR AN
ADDITIONAL MEMBER OF THE GOVERNING BOARD OF
THE AUTHORITY TO BE APPOINTED BY A MAJORITY OF
THE RESIDENT MEMBERS OF THE BERKELEY,
CHARLESTON, AND DORCHESTER COUNTY LEGISLATIVE
DELEGATIONS, AND BY ADDING SECTION 51-13-766, SO AS
TO AUTHORIZE THE AUTHORITY TO MAINTAIN SEPARATE
ACCOUNTS FOR PRIVATE DONATIONS AND TO PROVIDE
FOR THE USE OF THE FUNDS IN THOSE ACCOUNTS.
Be it enacted by the General Assembly of the State of South
Carolina:
SECTION 1. Section 51-13-720 of the 1976 Code is amended to
read:
"Section 51-13-720. Members of the authority must be appointed
by the Governor as follows: one upon the joint recommendation of
the Chairman of the House Ways and Means Committee and the
Speaker of the House, one upon the joint recommendation of the
Chairman of the Senate Finance Committee and the President Pro
Tempore of the Senate, and three to be appointed by the Governor.
The Governor shall appoint the chairman. The terms of the
members are for four years and until their successors are appointed
and qualify. The initial term of office of the chairman is for
seven years, the initial terms of office of the other members
appointed by the Governor are for six years, the initial term of office
for the member appointed by joint recommendation of the Chairman
of the House Ways and Means Committee and the Speaker of the
House is for four years, and the initial term of office for the member
appointed by joint recommendation of the Chairman of the Senate
Finance Committee and the President Pro Tempore of the Senate is
for four years. The term of office of all members after the initial term
shall be for four years. All members shall continue to serve until
their successors are appointed and qualified. Members may
succeed themselves. Vacancies must be filled in the same manner
of as the original appointment for the remainder of
the unexpired term."
SECTION 2. Article 11, Chapter 13, Title 51 of the 1976 Code is
amended by adding:
"Section 51-13-726. In addition to the members of the Patriot's
Point Development Authority provided for in Sections 51-13-720 and
51-13-725, one voting member must be appointed by a majority of
the resident members of the Berkeley, Charleston and Dorchester
County Legislative Delegations. The initial term of the member
appointed pursuant to the provisions of this section is five years;
thereafter the term of office of this member is governed by the
provisions of Section 51-13-720."
SECTION 3. Article 11, Chapter 13, Title 51 of the 1976 Code is
amended by adding:
"Section 51-13-766. All property and money donations from
private (i.e. non-government) sources made to the Patriot's Point
Authority or to any other person or organization and received by the
Authority, along with all interest generated on these donations, will
be segregated, kept and used by the Authority separate from the
monies in the State General Fund, and will be exempt from the South
Carolina Procurement Code and regulations."
SECTION 4. This act takes effect upon approval by the Governor.
