A JOINT RESOLUTION

PROPOSING AN AMENDMENT TO SECTION 8, PreviousARTICLENext XVII OF THE CONSTITUTION OF SOUTH CAROLINA, 1895, RELATING TO THE PROHIBITION ON PUBLIC OFFICERS GAMBLING OR BETTING ON GAMES OF CHANCE, SO AS TO PROVIDE AN EXCEPTION THAT ALLOWS PARTICIPATION IN LOTTERIES CONDUCTED BY THE STATE OF SOUTH CAROLINA.

    Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1.    It is proposed that Section 8, PreviousArticleNext XVII of the Constitution of this State be amended to read:

    "Section 8.    It shall be unlawful for a Any person holding an office of honor, trust or profit who is convicted of any offense of this State related to engage in gambling or betting on games of chance; and any such officer, upon conviction thereof, shall become thereby disqualified from the further exercise of the functions of his office, and the office of said person shall become vacant, as in the case of resignation or death."/

SECTION    2.    The proposed amendment must be submitted to the qualified electors at the next general election for representatives. Ballots must be provided at the various voting precincts with the following words printed or written on the ballot:

    "Must Section 8, PreviousArticle XVII of the Constitution of this State relating to the prohibition on public officers gambling or betting on games of chance, be amended so as to provide that the prohibition and the resulting disqualification from holding office applies only to a conviction of a gambling offense of the laws of this State?

    Yes    []

    No    []

    Those voting in favor of the question shall deposit a ballot with a check or cross mark in the square after the word 'Yes', and those voting against the question shall deposit a ballot with a check or cross mark in the square after the word 'No'."
