PROPOSING AN AMENDMENT TO SECTION 8, PreviousARTICLENext XVII OF THE CONSTITUTION OF SOUTH CAROLINA, 1895, RELATING TO THE PROHIBITION ON PUBLIC OFFICERS GAMBLING OR BETTING ON GAMES OF CHANCE, SO AS TO PROVIDE THAT THE PROHIBITION APPLIES ONLY TO THE GOVERNOR, CONSTITUTIONAL OFFICERS, AND MEMBERS OF THE GENERAL ASSEMBLY AND APPLIES ALSO TO PARTICIPATION IN LOTTERIES CONDUCTED BY THE STATE OF SOUTH CAROLINA.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1. It is proposed that Section 8, PreviousArticleNext XVII of the Constitution of this State be amended to read:

"Section 8.    It shall be unlawful for any person holding an office of honor, trust or profit the governor, constitutional officers, and members of the General Assembly to engage in gambling or betting on games of chance;, including participation in lotteries conducted by the State of South Carolina, and any such officer person, upon conviction thereof, shall become thereby disqualified from the further exercise of the functions of his office, and the office of said person shall become vacant, as in the case of resignation or death."

SECTION    2.    The proposed amendment must be submitted to the qualified electors at the next general election for representatives. Ballots must be provided at the various voting precincts with the following words printed or written on the ballot:

"Must Section 8, PreviousArticle XVII of the Constitution of this State relating to the prohibition on public officers gambling or betting on games of chance, be amended so as to limit this prohibition to the governor, constitutional officers, and members of the General Assembly and to include within the prohibited activities participation in lotteries conducted by the State of South Carolina?

Yes    [ ]

No    [ ]

Those voting in favor of the question shall deposit a ballot with a check or cross mark in the square after the word 'Yes', and those voting against the question shall deposit a ballot with a check or cross mark in the square after the word 'No'."
