REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, page 1, Section 59-101-450(B), by striking lines 30-31 and inserting:

/    (B)    By no later than January 1, 2009, a public institution of higher learning located in the State of South Carolina must not assign an        /

TO AMEND PreviousARTICLENext 1, CHAPTER 101, TITLE 59, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO COLLEGES AND INSTITUTIONS OF HIGHER LEARNING GENERALLY, BY ADDING SECTION 59-101-450, SO AS TO PREVENT PUBLIC INSTITUTIONS OF HIGHER LEARNING FROM USING THE SOCIAL SECURITY NUMBER OF A STUDENT AS THE INDIVIDUAL IDENTIFICATION NUMBER OF THE STUDENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    PreviousArticle 1, Chapter 101, Title 59 of the 1976 Code is amended by adding:

"Section    59-101-450.    (A)    For purposes of this section, 'public institution of higher learning' means any state-supported post-secondary educational institution and includes technical and comprehensive educational institutions.

(B)    On and after July 1, 2006, a public institution of higher learning located in the State of South Carolina must not assign an individual identification number to a student at the public institution that is identical to the social security number of the student. The public institution must not permit the display of the social security number of the student, or any four or more consecutive numbers contained in the social security number of the student, on any Internet site maintained by the public institution or on any other publicly accessible document.

(C)    Public institutions of higher learning located in the State of South Carolina that, prior to July 1, 2006, have assigned to a student an identification number identical to the social security number of the student must, by July 1, 2006, replace the existing social security number identification number with a different identification number, as provided in subsection (A) of this section.

(D)    This section does not exempt any public institution of higher learning located in the State of South Carolina from any duty of compliance it has with a federal law that:

(1)    regulates the collection or use of social security numbers by the public institution; or

(2)    protects the privacy rights of faculty, staff, or students.

(E)    This section does not prohibit the electronic transfer of student transcripts that contains students' social security numbers between educational institutions."

SECTION    2.    This act takes effect upon approval by the Governor.
