AN ACT TO AMEND THE CODE OF LAWS OF SOUTH
CAROLINA, 1976, BY ADDING SECTION 4-19-15 SO AS TO
PROVIDE THAT IN THOSE AREAS OF THE COUNTY WHERE FIRE
PROTECTION SERVICE IS OFFERED ON AN INDIVIDUAL
CONTRACTUAL BASIS, THE COUNTY GOVERNING BODY MAY
EXTEND FIRE PROTECTION TO THOSE LANDOWNERS WITHIN
THE SERVICE AREA WHO ARE NOT SERVED BY A CONTRACT
WITH ANOTHER POLITICAL SUBDIVISION.
Be it enacted by the General Assembly of the State of South Carolina:
Findings
SECTION 1. The General Assembly finds that the practice of offering fire
protection services to residents by contract is leaving parts of the State
without comprehensive service area coverage available to all citizens. The
effect of these arrangements has resulted in overlapping and ineffective
provision of fire protection service. The purpose of this act is to ensure that
all persons within an area are provided the same level of fire protection
service.
Extension of fire protection
SECTION 2. Chapter 19, Title 4 of the 1976 Code is amended by
adding:
"Section 4-19-15. In those areas of the county where fire
protection service is offered on an individual contractual basis, a county
governing body may extend fire protection to those landowners within the
service area who are not served by a contract with another political
subdivision."
Time effective
SECTION 3. This act takes effect upon approval by the Governor.
