A CONCURRENT
RESOLUTION
MEMORIALIZING CONGRESS TO REFRAIN FROM PASSING
ANY LEGISLATION THAT WOULD INFRINGE UPON
STATES' RIGHTS.
Whereas, the Congress should not have the authority to enforce
laws on the individual states that are unfunded or contrary to state
statutes based on the wishes of the people; and
Whereas, the National Conference of State Legislatures has voted
and demanded that Congress not pass preemptive state legislation;
and
Whereas, our system of government is based on the belief that each
state legislature should have the authority to govern its people; and
Whereas, uniform legislation that preempts state law would have a
negative impact on the federal judicial system; and
Whereas, the Conference of Chief Justices has asked that Congress
not pass preemptive state legislation. Now, therefore,
Be it resolved by the House of Representatives, the Senate
concurring:
That the General Assembly of the State of South Carolina, by this
resolution, memorializes Congress to refrain from passing any
legislation that would infringe upon states' rights.
Be it further resolved that copies of this resolution be forwarded to
the President of the United States Senate, the Speaker of the United
States House of Representatives, and each member of South
Carolina's Congressional Delegation, all at Washington D.C.
