A Bill to amend Section 19-19-10, Code of Laws of South Carolina, 1976,
relating to witness fees in civil cases, so as to increase the maximum fee
from one to fifteen dollars for each day's attendance by a witness on a
summons or as a material witness and to increase from five to fifteen cents
the mileage allowance for witnesses in courts of common pleas and before the
judge of probate; to increase the maximum fee from fifty cents to seven
dollars for each day's attendance by a witness and to increase from five to
fifteen cents the mileage allowance for witnesses in magistrate's courts in
civil cases; and to provide for the amount to be paid by the person at whose
suit he is summoned.-amended title

AN ACT TO AMEND SECTION 19-19-10, CODE OF LAWS OF SOUTH CAROLINA, 1976,
RELATING TO WITNESS FEES IN CIVIL CASES, SO AS TO INCREASE THE MAXIMUM FEE FROM
ONE TO FIFTEEN DOLLARS FOR EACH DAY'S ATTENDANCE BY A WITNESS ON A SUMMONS OR AS
A MATERIAL WITNESS AND TO INCREASE FROM FIVE TO FIFTEEN CENTS THE MILEAGE
ALLOWANCE FOR WITNESSES IN COURTS OF COMMON PLEAS AND BEFORE THE JUDGE OF
PROBATE; TO INCREASE THE MAXIMUM FEE FROM FIFTY CENTS TO SEVEN DOLLARS FOR EACH
DAY'S ATTENDANCE BY A WITNESS AND TO INCREASE FROM FIVE TO FIFTEEN CENTS THE
MILEAGE ALLOWANCE FOR WITNESSES IN MAGISTRATE'S COURTS IN CIVIL CASES; AND TO
PROVIDE FOR THE AMOUNT TO BE PAID BY THE PERSON AT WHOSE SUIT HE IS SUMMONED.
Be it enacted by the General Assembly of the State of South Carolina:
Fees, mileage, allowance for witnesses
SECTION 1. Section 19-19-10 of the 1976 Code is amended to read:
"Section 19-19-10. In courts of common pleas and before the judge of
probate, witnesses shall receive fifteen dollars for every day's attendance on
summons, or on request when actually appearing and testifying as a material
witness, besides fifteen cents per mile for coming to court and returning by the
shortest practical route and ferriage, to be paid by the person at whose suit he
is summoned. In magistrate's courts in civil cases, witnesses shall receive
seven dollars per day for each day's attendance and the same mileage as is
allowed in circuit courts. Such amount must also be paid by the person at whose
suit he is summoned."
Time effective
SECTION 2. This act shall take effect upon approval by the Governor. |
