A Bill to amend Article 1 of Chapter 7 of Title 1, Code of Laws of South
Carolina, 1976, relating to the Attorney General and his assistants, by adding
Section 1-7-55 so as to authorize the Attorney General to prosecute a
counter-claim, cross-action, or any other appropriate action in a civil suit
on behalf of a public officer or employee.

AN ACT TO AMEND ARTICLE 1 OF CHAPTER 7 OF TITLE 1, CODE OF LAWS OF SOUTH
CAROLINA, 1976, RELATING TO THE ATTORNEY GENERAL AND HIS ASSISTANTS, BY ADDING
SECTION 1-7-55 SO AS TO AUTHORIZE THE ATTORNEY GENERAL TO PROSECUTE A
COUNTER-CLAIM, CROSS-ACTION, OR ANY OTHER APPROPRIATE ACTION IN A CIVIL SUIT ON
BEHALF OF A PUBLIC OFFICER OR EMPLOYEE.
Be it enacted by the General Assembly of the State of South Carolina:
Attorney General may prosecute
SECTION 1. Article 1 of Chapter 7 of Title 1 of the 1976 Code is amended by
adding:
"Section 1-7-55. When the Attorney General undertakes to defend any civil
action or proceeding on behalf of any officer or employee of the State, or of any
political subdivision of the State, he may, in his discretion, upon the request
of the officer or employee, enter and prosecute a counter-claim, cross-action,
or any otherappropriate action in the suit on behalf of the officer or
employee."
Time effective
SECTION 2. This act shall take effect upon approval by the Governor. |
