A BILL
TO AMEND ACT 779 OF 1988, AS AMENDED, RELATING TO
LAURENS COUNTY SCHOOL BOARD OF TRUSTEES, TO
PROVIDE THAT IF THE NUMBER OF QUALIFIED
CANDIDATES OFFERING FOR ELECTION IS EQUAL TO THE
NUMBER OF EXISTING VACANCIES, THEN THE
CANDIDATES MUST BE DEEMED ELECTED WITHOUT AN
ELECTION BEING HELD.
Be it enacted by the General Assembly of the State of South
Carolina:
SECTION 1. Section 1(D) of Act 779 of 1988, as last amended by
Act 174 of 1995, is further amended to read:
"(D) The county election commission shall conduct and
supervise the elections for members of the board in the manner
governed by the election laws of this State, mutatis mutandi. The
county election commission shall prepare the necessary ballots,
appoint managers for the voting precincts, and do all things necessary
to carry out the elections, including the counting of ballots and
declaring the results of the election. The county election commission
shall give notice of the time and purpose of the election by
advertisement in a newspaper having general circulation in the
county in at least two weekly issues immediately preceding the date
of the election. The costs of the election must be borne by the
district. If the number of qualified candidates offering for
election is equal to the number of existing vacancies, then the
candidates must be deemed elected without an election being
held."
SECTION 2. This act takes effect upon approval by the Governor.
