A BILL

TO AMEND SECTION 54-3-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO APPOINTMENT AND TERMS OF MEMBERS OF THE BOARD OF THE STATE PORTS AUTHORITY, SO AS TO FURTHER PROVIDE FOR THE COMPOSITION OF THE BOARD AND TO PROVIDE DEFINITIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 54-3-20 of the 1976 Code is amended to read:

"Section 54-3-20. (A) The members of the board shall be appointed by the Governor, with the advice and consent of the Senate, for terms of seven years each and until their successors shall have been appointed and have qualified. In the event of a vacancy, however caused, a successor shall be appointed in the manner of original appointment for the unexpired term.

(B) Of the nine members of the board, five shall be selected from individuals engaged in the private maritime transportation industry in general or who have worked at least five years in the private maritime transportation industry in general, but reasonable efforts must be made to ensure corporate port operations representation. The four remaining members shall be at-large appointments.

(C) For the purposes of this section, the private maritime transportation industry includes, but is not limited to, any company or individual that ships, receives, transports, stores, handles, distributes, or otherwise manages any ocean borne cargo. Port operations include, but are not limited to, those services provided directly to vessels calling the ports of South Carolina."

SECTION 2. This act takes effect upon approval by the Governor.
