A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-11-81 SO AS TO AUTHORIZE THE COMPTROLLER GENERAL TO PAY PREMIUMS FOR THE PREPAID LEGAL INSURANCE OF STATE EMPLOYEES BY MEANS OF PAYROLL DEDUCTION AND TO PROVIDE THE CONDITIONS APPLICABLE WITH RESPECT TO THESE PAYROLL DEDUCTIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 1, Chapter 11, Title 8 of the 1976 Code is amended by adding:

"Section 8-11-81. The Comptroller General, upon request of employees of the State, may make deductions from the compensation of the employees for the payment of fees for prepaid legal services as defined in Section 37-16-10(3) and offered by prepaid legal companies as defined in Section 37-16-10(2) and regulated by the South Carolina Department of Consumer Affairs. The Comptroller General may not make deductions where deductions are made for less than two hundred and fifty state employees in any particular plan. The Comptroller General shall pay over to the prepaid legal company all amounts collected or withheld pursuant to this section. No part of the cost of the prepaid legal services or expenses incidental to the payroll deduction must be borne by the State in connection with the deduction, nor may the State in any way aid prepaid legal companies in the solicitation of policies by expressly or implicitly endorsing any particular prepaid legal services or prepaid legal company."

SECTION 2. This act takes effect upon approval by the Governor.
