A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-11-81 SO AS TO AUTHORIZE THE COMPTROLLER GENERAL TO PAY A PREMIUM FOR THE PREPAID LEGAL INSURANCE OF A STATE EMPLOYEE BY MEANS OF PAYROLL DEDUCTION AND TO PROVIDE THE CONDITIONS APPLICABLE WITH RESPECT TO THE PAYROLL DEDUCTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 11, Title 8 of the 1976 Code is amended by adding:

"Section 8-11-81.    The Comptroller General, upon request of an employee of the State, may make a deduction from the compensation of the employee for the payment of a fee for prepaid legal services as defined in Section 37-16-10(3), offered by a prepaid legal company as defined in Section 37-16-10(2), and regulated by the South Carolina Department of Consumer Affairs. The Comptroller General may not make deductions for fewer than two hundred fifty state employees in any particular plan. The Comptroller General shall pay over to the prepaid legal company amounts collected or withheld pursuant to this section. The cost of the prepaid legal services or expenses incidental to the payroll deduction must not be borne, in whole or in part, by the State in connection with the deduction, nor may the State aid a prepaid legal company in the solicitation of a policy by expressly or implicitly endorsing a particular prepaid legal service or prepaid legal company."

SECTION    2.    This act takes effect upon approval by the Governor.
