A BILL
TO AMEND SECTION 7-13-2110, CODE OF LAWS OF SOUTH
CAROLINA, 1976, RELATING TO THE EXPLANATION OF
CONSTITUTIONAL AMENDMENTS PREPARED BY THE
CONSTITUTIONAL BALLOT COMMISSION, SO AS TO
REQUIRE PRINTING OF THE PROPOSED CONSTITUTIONAL
QUESTION, AS WELL AS ITS EXPLANATION, AND REQUIRE
THE PROPOSED QUESTION AND EXPLANATION BE
PRESENTED IN A NEWSPAPER OF GENERAL CIRCULATION
IN EACH COUNTY WITH THE COST OF ALL PRINTINGS
BEING BORNE BY THE STATE ELECTION COMMISSION.
Be it enacted by the General Assembly of the State of South
Carolina:
SECTION 1. Section 7-13-2110 of the 1976 Code is amended to
read:
"Section 7-13-2110. In addition to all other requirements of law
and the Constitution of this State, when any a
proposed amendment to the Constitution is submitted to the electorate
for approval or disapproval in the general election and the proposed
amendment is of such a nature that it might not be
clearly understood by the voters, a simplified or, when appropriate,
more detailed explanation of the meaning and effect of such
the amendment shall must be placed
upon on the ballot along with the proposed amendment
question. When mechanical devices for voting are used, printed
copies, using a print size easily readable, of such
the explanation along with the question
shall must be made available at each voting precinct.
Each county board of voter registration shall designate a
newspaper of general circulation in the county who must print each
question and explanation at least one week before the election at
which the qualified elector will vote on the questions. All costs for
the printing must be paid by the State Election Commission.
The provisions of this section shall apply only to statewide
amendments."
SECTION 2. This act takes effect upon approval by the Governor.
