AN ACT TO AMEND SECTION 16-11-590, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DESTRUCTION OF SEA OAT PLANTS, SO AS TO PROVIDE THAT IT SHALL ALSO BE UNLAWFUL TO COLLECT, CUT, PreviousBREAKNext OR OTHERWISE DESTROY VENUS'S FLYTRAP PLANTS AND INCREASE THE FINE PENALTY FROM NOT LESS THAN TEN DOLLARS NOR MORE THAN ONE HUNDRED DOLLARS TO NOT MORE THAN TWO HUNDRED DOLLARS.

Be it enacted by the General Assembly of the State of South Carolina:

Unlawful to destroy sea oat plants or venus fly traps on public property

Section 1. Section 16-11-590 of the 1976 Code is amended to read:

"Section 16-11-590. It shall be unlawful for any person to cut, collect, Previousbreak or otherwise destroy sea oat plants, Venus's flytrap plants or any part on public property or on private property without the owner's consent. Any person violating the provisions of this section shall be guilty of a misdemeanor and upon conviction shall be fined not more than two hundred dollars or imprisoned not more than thirty days nor less than five days. Each violation shall constitute a separate offense."

Time effective

Section 2. This act shall take effect upon approval by the Governor.
