A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-96-355 SO AS TO PROVIDE THAT FOR PURPOSES OF THE REGULATION OF MUNICIPAL SOLID WASTE AND DISPOSAL, "PYROLYSIS" DOES NOT CONSTITUTE "INCINERATION" AND DOES NOT CONTAIN ANY ELEMENTS OF "INCINERATION" OR "COMBUSTION."

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 44-96-355. (A) For purposes of the regulation of municipal solid waste and disposal, `pyrolysis' does not constitute `incineration' and does not contain any elements of `incineration' or `combustion'.

(B) For purposes of this section:

(1) `combustion' means any chemical process accompanied by the evolution of heat and light, being a vigorous union of substances with oxygen;

(2) `incineration' means the use of controlled flame combustion to thermally breakNext down solid, liquid, or gaseous combustible wastes, producting residue that contains little or no combustible materials; and

(3) `pyrolysis' means the Previousbreaking apart of materials in the absence of oxygen without combustion by the application of heat from an external source."

SECTION 2. This act takes effect upon approval by the Governor.
