A BILL

TO AMEND SECTION 61-6-120, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PROXIMITY REQUIREMENTS FOR ESTABLISHMENTS AND PLACES OF BUSINESS WITH LIQUOR LICENSES, SO AS TO AUTHORIZE A PreviousCHURCHNext TO WAIVE THE DISTANCE REQUIREMENT.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 61-4-520(7) of the 1976 Code is amended to read:

"(7) The department may consider, among other factors, as indications of unsuitable location, the proximity to residences, schools, playgrounds, and PreviouschurchesNext. In planned development districts, pursuant to Section 6-29-730(C)(4), the governing body of a PreviouschurchNext, by an affirmative vote of a majority of the governing body's membership, may waive the distance factor in this item for the location of the business applying for or renewing a license provided for in this article. This item does not apply to locations licensed before April 21, 1986."

SECTION 2. Section 61-6-120(A) of the 1976 Code, as last amended by Act 458 of 1996, is further amended by adding the following paragraph at the end:

"In planned development districts, pursuant to Section 6-29-730(C)(4), the governing body of a Previouschurch, by an affirmative vote of a majority of the governing body's membership, may waive the distance requirement of this subsection for the location of the business applying for or renewing a license provided for in this article."

SECTION 3. This act takes effect upon approval by the Governor.
