S 0391 Joint Resolution, By T.E. Smith
A Joint Resolution proposing an amendment to Sections 6, 7, 8, 9, 10, 11, 12,
and 16 of Article IV of the Constitution of South Carolina, 1895, relating to
the Executive Department so as to delete the provisions relating to the
election, term, qualifications, duties, and compensation of the lieutenant
governor, relating to the requirement that the Senate member acting as
lieutenant governor shall vacate his seat so as to allow an election to fill
the seat, and relating to the prohibition on the voting power of the presiding
officer of the Senate, unless the Senate is equally divided; to provide for
the election of the President of the Senate from the members of the Senate; to
provide for the President of the Senate to assume the duties of the Office of
the President Pro Tempore of the Senate relating to notification of the
disability of the governor to discharge the powers and duties of the
governor's office; and to provide for the President of the Senate to assume
the duties of the Office of the Lieutenant Governor relating to succession to
governor when the governor-elect dies, declines to serve, or fails to take the
oath or when the governor is removed from office by impeachment, death,
resignation, disqualification, disability, or removal from the State;
presiding in the Senate; and the authority to act in an emergency.
