AN ACT TO AMEND ACT 111 OF 1977, AS AMENDED, RELATING TO AUCTIONS AND
AUCTIONEERS, SO AS TO PROVIDE FOR THE AUCTIONEERS' COMMISSION TO EMPLOY AN
EXECUTIVE DIRECTOR WHO SHALL HAVE A MINIMUM OF FIVE YEARS EXPERIENCE AS AN
AUCTIONEER AND TO DELETE THE PROVISION FOR THE COMMISSION TO EMPLOY A
SECRETARY-TREASURER.
Be it enacted by the General Assembly of the State of South Carolina:
Commission members
SECTION 1. Section 4 of Act 111 of 1977 is amended to read:
"Section 4. Of the initial five members, one member must be appointed to
serve for a term of one year, two members must be appointed to serve for a term
of two years, and two members must be appointed to serve for a term of three
years. At least three of the initial five members of the commission must be
experienced auctioneers and must be active in the auction profession. Beginning
July 1, 1977, at least three members of the commission must be licensed
auctioneers. Any action taken by the commission may be taken by a vote of any
three of its members. A quorum consists of three members. The members shall
elect from among themselves a chairman who shall serve for a term of one year and
until his successor is elected and qualifies. No member may serve more than two
successive terms as chairman. The members of the commission shall receive the
same per diem, mileage, and subsistence as is provided by law for members of
state boards, committees, and commissions. The commission shall employ an
executive director, who shall have a minimum of five years experience as an
auctioneer, an investigator or investigators, and other employees as it considers
necessary to carry out the duties prescribed by this act. All employees serve
at the pleasure of the commission. The commission shall issue, suspend, and
revoke licenses for auctioneers and apprentice auctioneers as provided in this
act and may promulgate regulations as may be necessary to carry out the
provisions of this act."
Time effective
SECTION 2. This act shall take effect upon approval by the Governor. |
