AN ACT TO AMEND SECTIONS 44-53-190, 44-53-210, 44-53-250, AND 44-53-270, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CONTROLLED SUBSTANCES, SO AS TO DELETE SUFENTANIL AND ADD ALFENTANYL TO SCHEDULE I; TO ADD PARAHEXYL AND METHAQUALONE TO SCHEDULE I; TO ADD SUFENTANIL AND DELETE METHAQUALONE FROM SCHEDULE II; TO ADD NEW CONTROLLED SUBSTANCES TO SCHEDULE IV; AND BY DELETING LOPERAMIDE FROM SCHEDULE V.

Be it enacted by the General Assembly of the State of South Carolina:

Controlled substances

SECTION 1. Item 45 of subsection (b) of Section 44-53-190 of the 1976 Code is amended to read:

"45. Alfentanyl".

Further

SECTION 2. Subsection (d) of Section 44-53-190 of the 1976 Code is amended by adding:

"22. Parahexyl".

Further

SECTION 3. Subsection (e) of Section 44-53-190 of the 1976 Code is amended by adding:

"(2) Methaqualone.".

Further

SECTION 4. Subsection (c) of Section 44-53-210 of the 1976 Code is amended by adding:

"24. Sufentanil".

Further

SECTION 5. Section 44-53-210 of the 1976 Code, as last amended by Act 423 of 1982, is further amended by deleting subsection (e).

Substances included in Schedule IV

SECTION 6. Section 44-53-250 of the 1976 Code is amended by adding a new first paragraph to read:

"The controlled substances in this section are included in Schedule IV."

Depressants

SECTION 7. Subsections (a) and (b) of Section 44-53-250 of the 1976 Code are amended to read:

"(a) Depressants. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of the following substances having a depressant effect on the central nervous system, including its salts, isomers, (whether position, geometric, or optical), and salts of such isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation:

(1) Alprazolam

(2) Barbital

(3) Bromazepam

(4) Camazepam

(5) Chloral Betaine

(6) Chloral Hydrate

(7) Chlordiazepoxide

(8) Clobazam

(9) Clonazepam

(10) Clorazepate

(11) Clotiazepam

(12) Cloxazolam

(13) Delorazepam

(14) Diazepam

(15) Estazolam

(16) Ethchlorvynol

(17) Ethinamate

(18) Ethyl Loflazepate

(19) Fludiazepam

(20) Flunitrazepam

(21) Flurazepam

(22) Halazepam

(23) Haloxazolam

(24) Ketazolam

(25) Loprazolam

(26) Lorazepam

(27) Lormetazepam

(28) Mebutamate

(29) Medazepam

(30) Meprobamate

(31) Methohexital

(32) Methylphenobarbital

(b) Stimulants. Unless specifically excepted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of the following substances having a stimulant effect on the central nervous system, including its salts, isomers (whether position, geometric, or optical), and salts of such isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation:

(1) Diethylpropion

(2) Mazindol

(3) Phentermine

(4) Pemoline, including organometallic complexes and chelates thereof.

(5) Pipradol

(6) SPA [(-)-1-Dimethylamino-1, 2-diphenylethane]."

Subsection deleted

SECTION 8. Section 44-53-270 of the 1976 Code is amended by deleting subsection (c).

Time effective

SECTION 9. This act shall take effect upon approval by the Governor.
