TO AMEND SECTION 29-3-330, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO METHODS OF ENTERING SATISFACTION, SO AS TO INCLUDE CERTAIN FULL-TIME JUDGES IN THE DEFINITION OF LICENSED ATTORNEY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 29-3-330 of the 1976 Code, as last amended by Act 67 of 1999, is further amended by adding:

"(f) For the purposes of this section only, 'licensed attorney' includes any full-time judge who can provide proof of payment of funds by evidence of payment made payable to the mortgagee, holder of record, servicer, or other party entitled to receive payment. A full-time judge shall not receive compensation for this service and shall only sign an affidavit pursuant to this section in order to satisfy an open mortgage or record that was paid in full in the course of a real estate closing which was handled by the judge when the judge was in private practice. A judge who acts in accordance with this section is not engaging in the practice of law as prohibited by the Code of Judicial Conduct."

SECTION 2. This act takes effect upon approval by the Governor and applies to causes of action filed on or after the effective date of this section.
