A BILL

TO AMEND SECTION 17-13-40, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO A LAW ENFORCEMENT OFFICER'S JURISDICTION WHEN HE IS IN PURSUIT OF AN OFFENDER, SO AS TO EXPAND THE JURISDICTION OF COUNTY POLICE AUTHORITIES WHEN THEY PURSUE OFFENDERS WHO VIOLATE A COUNTY ORDINANCE OR STATE STATUTE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 17-13-40(B) of the 1976 Code, as added by Act 265 of 1998, is amended to read:

"(B) When the police authorities of a county are in pursuit of an offender for a violation of a county ordinance or statute of this State committed within the unincorporated areas of the county, the authorities may arrest the offender, with or without a warrant, at a place within the unincorporated areas county, or at a place within an adjacent county."

SECTION 2. This act takes effect upon approval by the Governor.
