S 0489 General Bill, By Senate Banking and Insurance
A Bill to amend Section 31, Part II of Act 540 of 1986, the General
Appropriations Act, relating to insurance company license fees and premium
taxes, so as to remove dividends from the computation of total premiums for
purposes of the premium tax and to provide that retaliatory provisions apply
to a foreign insurer transacting business in this State regardless of whether
a similar South Carolina insurer is licensed to transact business in the
foreign company's state of domicile, to provide that comparisons of taxes and
other obligations must be based on an item-by-item comparison between South
Carolina taxes and obligations and similar taxes and obligations of the
foreign insurer's state of domicile, and to provide that municipal taxes and
fees may not be considered in the comparisons.
