S 0337 General Bill, By I.E. Lourie, Land and D.S. Taylor
A Bill to amend Section 42-5-30, as amended, Code of Laws of South Carolina,
1976, relating to the requirement that an employer or an insurance carrier
file evidence of compliance with Section 42-5-20 and other provisions of Title
42 (Workers' Compensation), so as to add provisions for a procedure regarding
filings if the insurance provides for the processing and handling of claims by
a company other than the issuing carrier through a claims clearinghouse or
claims-handling office, including designation of such clearinghouse or office
with the Industrial Commission and subjection of a carrier and a self-insurer
to the penalty provisions of Section 42-19-30 for failure to make certain
filings; and to amend the 1976 Code by adding Section 42-5-290, so as to
require carriers to designate a single claims office within the State, allow
the Industrial Commission to grant or withdraw approval for a carrier to
designate an out-of-state claims clearinghouse or claims-handling office,
provide that any such out-of-state clearinghouse or office is presumed
approved under certain conditions, provide for the staffing of a clearinghouse
or office, and require a foreign corporation to give prior notice that it is
coming into the State to do business.
