H 3352 General Bill, By A.V. Rawl, W.D. Arthur, J.D. Bradley, Fair,
J.V. Gregory, C.L. Sturkie and T.G. Woodruff
A Bill to prohibit the South Carolina Tax Commission from having or utilizing
a criminal intelligence division; to limit certain discovery procedures,
investigations, and intelligence-gathering by the Commission to civil actions
or proceedings; to provide that if the discovery procedures, investigations,
and intelligence-gathering are necessary for criminal actions, proceedings, or
prosecutions, the South Carolina Attorney General's Office shall carry out
these activities or conduct the investigations or the intelligence-gathering;
and to repeal Item (10) of Section 12-3-140, Code of Laws of South Carolina,
1976, relating to the Commission's authorization to examine cases in which,
among other things, evasion or violation of the laws of the State relating to
the assessment and taxation of property is complained of or discovered.
