A BILL
TO AMEND SECTION 30-4-40, AS AMENDED, CODE OF
LAWS OF SOUTH CAROLINA, 1976, RELATING TO
MATTERS EXEMPT FROM DISCLOSURE UNDER THE
FREEDOM OF INFORMATION ACT, SO AS TO EXEMPT
MATERIALS RELATING TO THE RECRUITMENT AND
EMPLOYMENT OF PUBLIC EMPLOYEES.
Be it enacted by the General Assembly of the State of South
Carolina:
SECTION 1. Section 30-4-40(a) of the 1976 Code, as last
amended by an Act of 1995 bearing Ratification Number 513 of
1994, is further amended by adding an appropriately numbered item
to read:
"( ) All materials, whether printed or otherwise that are
gathered by a public body during a search for an employee.
(i) For the purpose of this item `all materials whether printed
or otherwise' include, but are not limited to, any person's name,
address, telephone number, social security number, photograph,
driver's license number, employment application, resume, vita,
endorsement letter, test record, education transcript, portfolio, video
tape, audio tape, art work, drawing, plan, or any material that may
be considered as a part of the employment process.
(ii) For the purpose of this item `search' means the process of
seeking information from persons interested in becoming an
employee of a public body."
SECTION 2. This act takes effect upon approval by the
Governor.
